Terms of Use

Penfont is a Mac app that turns your handwriting into a font, made by Insania Labs LLC ("Insania Labs", "we", "us"). These terms apply when you download, install or use Penfont, whichever way you got it. If you do not agree to them, please do not use the app.

Where you got Penfont

• Mac App Store. Your purchase is also covered by Apple's Licensed Application End User License Agreement. If it conflicts with these terms, Apple's agreement wins for the App Store copy. Apple handles payment, refunds and updates.
• Setapp. You use Penfont as part of your Setapp membership, under Setapp's own terms. Setapp handles payment and access. Your access to Penfont ends when your membership ends.
• Directly from us. You buy a licence key through Polar, which processes the payment as merchant of record. The key activates Penfont on your Mac. To move it to another Mac, first choose Use on Another Mac in Penfont's licence window. Updates arrive through the app's built-in updater.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to use Penfont on Macs you own or control, as allowed by the way you got it. You may not resell, rent, share or publish licence keys, redistribute the app, or remove its licence check. You also may not reverse engineer it, except where the law lets you do so anyway. Penfont, its name, its template and its artwork belong to Insania Labs and its licensors.

Your handwriting and your fonts

Your handwriting, the photos you take of it, and the fonts Penfont makes from it are yours. Insania Labs claims no rights in them. You can use, install, share and sell the fonts you make. You are responsible for only turning handwriting into a font when you have the right to use it, and for what you do with the fonts once you export them.

Refunds

App Store purchases are refunded by Apple, and Setapp membership by Setapp. For a direct purchase, write to support@insanialabs.com with the email you used at checkout.

No warranty

PENFONT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT EVERY CHARACTER WILL BE RECOGNISED OR DRAWN EXACTLY AS WRITTEN.

Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, INSANIA LABS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF PENFONT. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR IT. Some places do not allow these limits, so they may not apply to you.

Ending these terms

Your licence ends if you break these terms. When it ends, stop using Penfont and delete it. Fonts you already made stay yours.

Governing law

These terms are governed by the laws of Florida, USA, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida. This does not take away any rights you have under the consumer law of the country where you live.

Changes

If these terms change, the new version will be posted on this page with a new date.
